Deputy Prosecutor
Incumbent serves as Deputy Prosecutor for the Morgan County Prosecutor’s Office, responsible for preparing and presenting case evidence and testimony in court.
DUTIES:
Conducts legal research associated with prosecutions of assigned cases, reviewing related court decisions and legal procedures. Studies, interprets, and applies laws to facts.
Reviews complaints filed with the Prosecutor’s Office, interviews involved parties, and gathers any additional information.
Prepares case for prosecutions, including legal documents and filings, such as motions and petitions.
Represents the State in Circuit and Superior Courts and City and Town Courts, including conducting jury selection, presenting opening statements, conducting direct and cross- examinations of witnesses, presenting closing arguments, and negotiates plea agreements for the State.
Prosecutes cases in criminal trials. Files criminal charges and conducts disposition.
Meets with clients and the public about legal rights, responsibilities, and processes involved in seeking court relief. Meets with police officers on legal procedures and requirements relating to the performance of their duties.
Prepares all files for court and creates discovery responses. Serves on call and does search warrants.
Performs additional duties as assigned and/or required by law.
JOB REQUIREMENTS:
Doctor of Jurisprudence with license to practice law in the State of Indiana. Must pass the Indiana State Bar Exam.
Ability to meet all hiring requirements, including passage of a drug test.
Complete knowledge of and ability to apply federal, state, and local laws and ordinances to a variety of individual situations and circumstances for the preparation and prosecution of cases before the court.
Knowledge of constitutional, criminal, and traffic law.
Working knowledge of standard office procedures and computer software programs used by the Prosecutor's Office, with ability to apply such knowledge to a variety of interrelated processes, tasks and operations.
Working knowledge of standard English grammar, spelling and punctuation, and ability to prepare court/legal documents and detailed written reports as required.
Ability to supervise and provide legal support for case workers, including planning, delegating, and controlling work assignments, and occasionally directing special projects.
Ability to operate standard office equipment, such as computer, calculator, copier, printer, telephone, and printer.
Ability to effectively communicate, orally and in writing, with co-workers, other County departments, Courts, police departments, attorneys, Judges, and the public, including being sensitive to professional ethics, gender, cultural diversities and disabilities.
Ability to provide public access to, or maintain confidentiality of, department information and records according to state requirements.
Ability to comply with all employer and department policies and work rules, including, but not limited to, attendance, safety, drug-free workplace, and personal conduct.
Ability to competently serve the public with diplomacy and respect, including occasional encounters with irate/hostile persons.
Ability to understand, memorize, retain and carry out oral and written instructions and present findings in oral or written form.
Ability to compare or observe similarities and differences between data, people or things.
Ability to compile, collate, or classify data, analyze, evaluate and investigate, coordinate and take action based on data analysis, and hypothesize data.

Ability to work alone with minimum supervision and with others in a team environment, often amidst frequent distractions and interruptions.
Ability to apply knowledge of people/locations and plan/layout assigned work projects.
Ability to work extended hours, evenings, and weekends, travel out of town for conferences/training, sometimes overnight, respond to emergencies on a 24-hour basis, and serve on call on rotation basis.
DIFFICULTY OF WORK:
Incumbent applies a broad scope of rules and regulations in developing effective approaches for prosecution of criminal offenders in Morgan County. Incumbent exercises independent judgment in adapting basic guidelines and accepted procedures to meet specific situations and fit highly complex or contradictory circumstances.
RESPONSIBILITY:
Incumbent receives indirect or occasional supervision. Assignments are guided by definite objectives using a variety of methods or procedures. Incumbent plans and arranges own work. Frequently, decisions are made which are restricted only by organization-wide policies. Work is primarily reviewed for soundness of judgement, compliance with legal requirements, and effect on department goals and objectives.
PERSONAL WORK RELATIONSHIPS:
Incumbent maintains frequent contact with co-workers, other County departments, Courts, police departments, attorneys, Judges, and the public for purposes of giving and receiving information, rendering service, and negotiating.
Incumbent reports directly to Chief Deputy Prosecutor.
PHYSICAL EFFORT AND WORK ENVIRONMENT:
Incumbent performs duties in a standard office environment and in a courtroom, involving sitting/walking at will, sitting for long periods, lifting/carrying objects weighing under 25 pounds, speaking clearly, and hearing sounds/communication. Incumbent maintains considerable contact with victims and defendants and may be exposed to irate/hostile individuals.
Incumbent works extended hours, evenings, and weekends, travels out of town for conferences/training, sometimes overnight, responds to emergencies on a 24-hour basis, and serves on call on rotation basis.
